Two teenage brothers from Georgia, Dwayne and Major Tolbert, made their first court appearance after being accused of shooting at other teenagers at a birthday party in January. During the hearing, Clayton County Magistrate Court Judge Latrevia Kates-Johnson did not hold back, reprimanding the brothers for their actions.
The charges, which include aggravated assault with a deadly weapon and reckless conduct, highlight a disturbing case of gun violence involving minors.
The Shooting Incident
The shooting occurred in January at a birthday party, where the Tolbert brothers were allegedly involved in a fight after being kicked out of the event. The dispute quickly escalated, and one or both of the brothers allegedly opened fire, injuring a minor who was shot in the leg. Following the shooting, the brothers reportedly posted a video of the incident on Instagram, bragging about the attack.
This incident has drawn considerable attention, not only because of the violence but also because the brothers are being charged as adults. They were arrested on Tuesday and faced serious charges for their alleged involvement in the shooting.
The Court Appearance
During their video appearance on Thursday, the Tolbert brothers were met with a stern warning from Judge Latrevia Kates-Johnson. The judge expressed disbelief at the senselessness of the shooting and the potential consequences, telling the boys that they could have “literally killed somebody.”
She further emphasized the seriousness of their actions, reminding them that “this is no joke, when you’re out here shooting guns.”
When Dwayne Tolbert attempted to explain the situation by saying it was their cousin’s party, the judge stopped him before he could potentially incriminate himself. Judge Kates-Johnson’s firm stance on the matter reflected the gravity of the crime and the impact it could have had on the victim.
The Judge’s Admonishment
Judge Kates-Johnson conveyed the heartbreak she felt upon seeing such a young pair of defendants involved in such violent actions. She told the brothers, “It’s heartbreaking to see y’all young people where you are, and I’m seeing it every single day.”

Before concluding the hearing, Judge Kates-Johnson denied bond for both brothers, acknowledging the emotional toll their actions had taken on their parents. She noted, “I know your parents are devastated. She has two sons locked up.”
