Texas Lawmakers at Odds Over THC Ban Legislation, With Bills Stalled or Uncertain

Some Texas lawmakers have expressed frustration as a bill to ban THC products, along with two other related bills, appear to be stalled or even dead. Despite passing in the Senate, the proposed ban on THC products faces challenges, particularly with Governor Greg Abbott and Lt. Governor Dan Patrick at odds over its specifics.

Governor Abbott’s Veto and Path Forward

Governor Abbott vetoed the THC ban passed by the Senate after the regular legislative session. Abbott has stated that he supports banning THC products for individuals under 21 but insists on regulating the products for adult safety.

In a recent interview, Abbott suggested that a solution may be forthcoming, emphasizing collaboration with the Texas House to ensure the products remain safe while addressing concerns over younger users.

“We want to make sure the products are safe. So, I think there is a pathway forward that will get passed,” Abbott said, indicating that a compromise could be reached.

Bills Referred But Stalled in House

Despite progress in the Senate, the ban on THC products remains stalled in the House. The bill, SB 6, was referred to the House Public Health Committee on August 20 but has yet to be heard.

Similarly, Republican Representative Charlie Geren’s HB 36, which also aims to ban THC products for individuals younger than 21, has been stuck in the same committee since August 18.

A third bill, HB 6, filed by House Public Health Committee Chairman Gary Van Deaver, aims to regulate hemp products but has similarly seen no action.

Ongoing Discussions Amid Uncertainty

While some lawmakers doubt the success of the bills, Representative Van Deaver’s Chief of Staff indicated that discussions continue. However, the future of these bills remains uncertain, with some lawmakers believing that the second special session, set to end in mid-September, may wrap up as early as next week.

Lt. Governor Patrick’s Stance

Lt. Governor Dan Patrick has been a vocal proponent of the THC ban, recently reiterating his stance during a campaign-related news conference.

“This is a dangerous drug we must ban. You can’t regulate. If you regulate something, you legalize it,” Patrick stated. “We passed the ban. That’s where we stand, that’s where we will always stand.”
