The motion filed by Kelly’s lawyer, Beau B. Brindley, sought a temporary furlough for the singer due to what was described as urgent health concerns. However, Judge Martha Pacold ruled against the request, citing lack of jurisdiction.

The motion was filed in Illinois, where Kelly was convicted, but the request was based on incidents that occurred while Kelly was held in Arizona and North Carolina, where he is currently incarcerated.

“We are not surprised by this ruling,” Brindley said, acknowledging that jurisdictional issues made this request challenging. However, he emphasized that they had to act quickly due to the immediate threat to Kelly’s life.

Brindley claims that Kelly is suffering from blood clots in his lungs, which could be fatal without a necessary surgical procedure, a procedure he argues was blocked by prison officials.

According to Brindley, Kelly’s doctors at Duke University Hospital recommended a pulmonary embolectomy to treat the blood clots, but prison officials allegedly prevented the procedure from being carried out. The lawyer’s emergency visit to Kelly on June 18 further reinforced his concerns, stating that Kelly’s condition is critical.

After filing the motion, Brindley also alleged that Kelly had been placed in solitary confinement as a form of punishment for the legal actions he took.

While the Bureau of Prisons (BOP) declined to comment on the specifics of Kelly’s case, Assistant U.S. Attorney Jason Julien responded to Brindley’s motion by defending the decision to place Kelly in solitary confinement, calling it a measure to protect the singer.

He further noted Kelly’s criminal history, which includes a conviction for sexually exploiting children, forcing women and girls into sex trafficking, and violating the Mann Act.

Julien emphasized that Kelly has never taken responsibility for his actions, which include decades of sexual abuse. His comments painted Kelly’s history of abuse as a critical part of the larger context of the legal proceedings against him.

Kelly’s Current Sentence and Legal Strategy

R. Kelly is currently serving a 30-year sentence after being convicted in the Eastern District of New York for his involvement in a criminal enterprise that exploited young girls and women.
