R. Kelly, the infamous R&B singer, will remain in prison after a federal judge denied his request for a temporary furlough. Despite his lawyer’s claim that the singer is in serious danger and being denied life-saving treatment, the judge’s decision leaves Kelly continuing to serve his sentence in federal custody.
The Legal Motion and Denial
The motion filed by Kelly’s lawyer, Beau B. Brindley, sought a temporary furlough for the singer due to what was described as urgent health concerns. However, Judge Martha Pacold ruled against the request, citing lack of jurisdiction.
The motion was filed in Illinois, where Kelly was convicted, but the request was based on incidents that occurred while Kelly was held in Arizona and North Carolina, where he is currently incarcerated.
“We are not surprised by this ruling,” Brindley said, acknowledging that jurisdictional issues made this request challenging. However, he emphasized that they had to act quickly due to the immediate threat to Kelly’s life.
Brindley claims that Kelly is suffering from blood clots in his lungs, which could be fatal without a necessary surgical procedure, a procedure he argues was blocked by prison officials.
The Health Crisis
According to Brindley, Kelly’s doctors at Duke University Hospital recommended a pulmonary embolectomy to treat the blood clots, but prison officials allegedly prevented the procedure from being carried out. Brindley stressed that this delay in medical care is putting Kelly’s life at risk every day.
The lawyer’s emergency visit to Kelly on June 18 further reinforced his concerns, stating that Kelly’s condition is critical.
In addition to health concerns, Brindley filed a motion to vacate Kelly’s convictions in Illinois, claiming new evidence had come to light. He also asked for Kelly’s immediate release on bond while the legal process continues.
Allegations of Conspiracy and Solitary Confinement
The motion filed by Brindley includes allegations that Kelly’s life has been threatened by fellow inmates and even prison officials. It included a declaration from an inmate, Mikeal Glenn Stine, who claimed that he was approached in an Arizona detention facility to carry out an assignment to kill Kelly.
Stine’s allegations suggested that he was later transferred to Kelly’s current North Carolina facility, where he was housed in the same wing as Kelly, allegedly to complete the assignment.
Stine, known for his extensive history of filing civil suits and petitions, also has a criminal record for threatening the lives of federal officials. These dramatic claims added another layer of tension to Kelly’s ongoing legal battles.
After filing the motion, Brindley also alleged that Kelly had been placed in solitary confinement as a form of punishment for the legal actions he took.
The Prison’s Response
While the Bureau of Prisons (BOP) declined to comment on the specifics of Kelly’s case, Assistant U.S. Attorney Jason Julien responded to Brindley’s motion by defending the decision to place Kelly in solitary confinement, calling it a measure to protect the singer.
He further noted Kelly’s criminal history, which includes a conviction for sexually exploiting children, forcing women and girls into sex trafficking, and violating the Mann Act.
Julien emphasized that Kelly has never taken responsibility for his actions, which include decades of sexual abuse. His comments painted Kelly’s history of abuse as a critical part of the larger context of the legal proceedings against him.
Kelly’s Current Sentence and Legal Strategy
R. Kelly is currently serving a 30-year sentence after being convicted in the Eastern District of New York for his involvement in a criminal enterprise that exploited young girls and women. The charges included racketeering, forced labor, and the illegal transportation of minors across state lines for sex.
Despite his convictions and the severity of his crimes, Kelly’s legal team is actively seeking ways to challenge his sentence and his continued incarceration.
In addition to the current motions, Brindley is reportedly in discussions with people close to former President Donald Trump, hoping for a potential pardon.
