Woman died in crash at Preston and 380 Tuesday

The Dallas Morning News’ Valerie Wigglesworth reports that Frisco police say a 47-year-old Princeton woman died Tuesday night after a single-vehicle wreck at U.S. Highway 380 and Preston Road (State Highway 289).

The News reports that investigators say Jean Poe’s passenger vehicle was traveling eastbound on U.S. Highway 380 at high speed just before 8:30 p.m. Her vehicle crossed the median into oncoming traffic and crashed into the barrier on the north side of the highway under the Preston Road bridge. Poe died at the scene.

The highway was closed for several hours.

First warning: Frisco Mayor Maher Maso was quick to warn drivers to avoid the area Tuesday night, using Twitter to get the word out.

FATALITY ACCIDENT CLAIMS ONE LIFE
FRISCO, TX – Accident investigators with the police department’s Traffic Unit responded to a major vehicle accident that occurred last night at approximately 8:24 p.m. The accident occurred at US 380 and Preston Road.
The initial on-scene investigation by the Frisco Police Department has concluded and the roadway is currently open to motorists. Investigators have determined that a single passenger vehicle was travelling eastbound, at a high rate of speed. The vehicle crossed the median, into oncoming traffic and crashed into the barrier on the north side of US 380, under the Preston Road bridge.
The operator of the vehicle, 47-year-old Jean Poe of Princeton died at the scene. There were no additional occupants in the vehicle.

Ben Smith viewpoint: The high cost of inexperience

A newly elected district judge who lacks criminal jury trial experience will not be able to hit the ground running. There will be a learning curve. Mistakes that occur in criminal trials have severe and often irreparable consequences.

Of the candidates for the 380th district court, I have the most criminal jury trial experience. Two of my opponents have none. What’s the big deal, you ask? Your tax dollars, the efficiency and effectiveness of our court system, and public safety.

District courts are courts of original jurisdiction. They hear civil cases involving family and juvenile matters but they also hear criminal cases for felony crimes such as aggravated assault, rape, and murder.

Criminal cases are costly to tax payers. Nearly half of all criminal cases tried in Collin County utilize indigent defense funds (this includes juvenile, misdemeanor and felony cases). The county spent $3.98 million on indigent defense in 2011. The state’s indigent defense fund spent $198 million in 2011 of which it contributed only $410,804 in grant money to Collin County’s fund. Collin County has budgeted $5.6 million for indigent defense fund operations for FY 2012.

In addition, the Collin County Jail spends about $1.87 million of its nearly $19 million annual budget on operational expenses. On average, the Collin County Jail houses 1,000 inmates. It costs approximately $62 a day to provide care for each inmate.

The business of the district courts has far-reaching consequences for both victims and public safety. For example, let’s say the aforementioned resources are expended on a case involving sexual abuse of a child. It takes two years for attorneys on both sides to prepare their case. The case finally goes to trial and the child victim testifies on the witness stand. The accused is found guilty and sentenced. Later, appellate attorneys prove the judge made a mistake. The guilty verdict and sentencing is thrown out.

What happens next?  The case must be re-tried all over again at additional expense to taxpayers. It could take years before the case is brought back to trial, if at all. Meanwhile, the child victim has to go through the trial preparation and witness stand experience a second time. Key witnesses die or move, so the case against the accused is weakened. If the case isn’t retried, the defendant goes free. I’ve seen it happen.

Let’s flip the coin. Let’s say that the judge makes a mistake during the trial and the defendant is found not guilty.  Because of double jeopardy, there is no remedy.  The defendant is free and clear.

As a trial attorney, I’ve handled over 5,000 cases, including more than 100 jury trials. I spent eight years in the Collin County District Attorney’s Office as an assistant DA. I was the chief felony prosecutor at the time of my resignation in December 2011. I have substantial experience trying criminal cases in district court. Two of my opponents do not. I am uniquely qualified to oversee criminal cases and dispose of them in an efficient manner, thereby reducing the jail population and saving your tax dollars–and ultimately securing the closure victims and their survivors rightly deserve.
